The following general terms and conditions of the sales and service contract apply to all subscriptions made between:
- On the one hand, SARL Obsession Minérale with an initial capital of €15,000 – whose head office is at 100 route de l'Arps, 26190 Saint-Laurent-en-Royans – registered in the Trade and Companies Register of Romans
- And on the other hand the subscriber (hereinafter referred to as the "customer")
The General Conditions define the rights and obligations of the parties within the framework of the “contract of sale and provision of services”. Any subscription to this contract implies prior knowledge of these General Conditions as well as the customer's acceptance of all of their content:
- The customer acknowledges having the capacity to contract, that is to say in particular to have the majority and the legal capacity.
- The customer is responsible for his group, and as such undertakes to transmit all the information described in this contract to all participants and before the start of the canyoning, climbing or other similar activity.
I. DEFINITIONS
- “Obsession Minérale”: SARL specializing in the resale of sports activities; Activities: canyoning, Via Ferrata and climbing in the Sierra de Guara and in the Vercors.
- “Client”: natural person designated in the reservation form by “surname and first name” who makes the reservation. This person is responsible for all the participants in his group.
- “Participants”: natural persons designated in the reservation form who constitute the group as a whole (the client, the natural person designated in the reservation form by “surname and first name” who makes the reservation, included).
- “Services”: Canyoning is an outdoor activity consisting of progressing on foot in the bed of a watercourse following a route established in advance and alternating swimming, jumping, walking and abseiling. Climbing is an activity that consists of moving on the rock, with bare hands, ensured by a teammate using a rope and a harness on a route that is often drawn and secured in advance. The Via Ferrata is a sporting route made up of bars and metal cables that ensure progress on rock faces. The via corda is a sporting route on a cliff similar to the Via Ferrata except that the safety of the participants is ensured by a dynamic climbing rope and not by a metal cable. The evening or the night in portaledge consists of hanging a removable platform on the side of the cliff to spend a moment there. To do this and to access it we use climbing and via corda techniques.
All these services start at the start of the approach walk and end at the end of the return walk.
- “Instructor”: Professional with the necessary diploma to supervise the activity of canyoning, climbing, Via Ferrata, via corda, portaledge under the status of independent worker. He has total free will of the decisions to be made to perform or cancel the service.
II. TERMS OF RESERVATION OF OBSESSION MINÉRALE SERVICES
To validate the reservation, the customer must complete the reservation form in its entirety and tick the box: “I acknowledge having read and accepted the “General Conditions of the Obsession Minérale sales and service contract”; then click on the button “I confirm my reservation”.
III. EFFECTIVE DATES AND DURATION OF THE CONTRACT

- For institutional groups, a non-refundable reservation deposit of 20 % of the total amount will be requested to validate the reservation.

The Contract takes effect concomitantly with the validation of the reservation form by the customer on the website www.obsessionminerale.com and ends at the end of the last service performed by all the participants of the group and described in the reservation.
IV. OBSESSION MINÉRALE OBLIGATIONS TO CLIENT AND PARTICIPANTS
- Following the Customer's online reservation, Obsession Minérale undertakes to send an automatic message by email: "Confirmation of reservation for the activity", specifying the information relating to the group as well as the total cost of the service.
- Obsession Minérale undertakes to respond as soon as possible, with a reservation validation message by email, to validate or invalidate the reservation request, including a place and time of the meeting. This obligation disappears in the event of non-receipt of the reservation message for a reason beyond its control (problem of internet connection, message considered as SPAM, etc.).
- Obsession Minérale undertakes not to transfer any information concerning the client and the participants to third parties.
- Once the reservation has been validated by the Email "Confirmation of reservation for the activity", Obsession Minérale undertakes to make every effort to carry out the provision of services, which the customer has reserved.
- Obsession Minérale undertakes to provide the technical equipment for canyoning, Via Ferrata, via corda, climbing or portaledge suitable for carrying out the provision of services, to all participants in the activity.
- Obsession Minérale undertakes to verify the legal information concerning the professional instructor who supervises the client's group: up-to-date professional diploma, professional civil liability insurance, competence and ability to exercise this sports supervision function.
- Obsession Minérale undertakes to provide all participants in activities taking place in Aragon with "Individual customer accident" insurance to cover an accident or incident which would not engage the personal responsibility of the instructor and which would not be covered by the insurance. participant's own.
- Obsession Minérale undertakes to declare to its insurer any event involving its own civil liability.
V. CUSTOMER AND PARTICIPANT OBLIGATIONS TOWARDS OBSESSION MINÉRALE
- The customer guarantees the accuracy of the personal information transmitted concerning all the members of the group, and in particular: the surname and first name, a valid telephone number and email address, the date(s) of the activity, the level of group (occasional athlete – regular athlete – heterogeneous), the exact measurements of each participant.
- The customer agrees that he and all the participants in the group are in good physical condition for the practice of the activities. For canyoning, that they are comfortable in the aquatic environment (no fear of immersing themselves in water), and in the vertical environment. No participant must be subject to a medical contraindication.
- Participants agree to bring the following equipment: closed shoes with good ankle support (sneakers or walking shoes), and one liter of water per person, a swimsuit (for canyoning only) , a picnic in the event of a day trip.
- In the event of a medical problem, participants must inform Obsession Minérale and the instructor in charge of the group, the morning of the outing and ensure that there are no medical contraindications to the practice of the activities.
- Fight against the COVID-19 epidemic: participants undertake not to have had symptoms of the disease, nor to have been knowingly in contact with an infected person, during the 14 days preceding that of the activity.
- Participants agree not to be under the influence of drugs, alcohol, or other medications, which may affect their ability to understand and their physical capacity. Participants are responsible for taking medication for the duration of the service.
- The participants undertake to respect the safety instructions which will be transmitted to them by the professional instructor responsible for the group, throughout the duration of the service.
- Special conditions for sports canyoning: participants must have a very good experience of abseiling canyoning, and declare that they have no lesions or injuries to the lower limbs (ankles, knees, hips, etc.) which would slow down the progress of the group. Obsession Minérale may request the prior reservation of a classic canyon with the Obsession Minérale team, in order to assess the level and physical capacity of the participants.
VI. CANCELLATIONS AND GUARANTEES
- Following the customer's reservation and receipt of the message "Confirmation of reservation for the activity", Obsession Minérale does not guarantee availability on the desired dates. The reservation will be validated from the moment the customer receives the reservation validation message.
- Obsession Minérale has an obligation of means but no obligation of results. In other words, Obsession Minérale cannot guarantee the achievement of a perfect service, but will make every effort to achieve it. In particular, Obsession Minérale cannot guarantee the constancy of the natural elements: climatic conditions, water flows, water temperature, weather hazards, etc.
- Cancellation at the initiative of Obsession Minérale or the independent instructor: if the water level or weather conditions jeopardize the safety of the participants, or if the instructor considers that there is a danger for the participants due to If a physical level is considered insufficient, Obsession Minerale or the instructor reserve the right to cancel the outing at any time. The cancellation of the service entails the cancellation of the obligation to pay for the service, except in the case where the vertical or aquatic activity has already begun (that is to say from the moment when the participants immersed in the water in neoprene suits for aquatic activities, and from the moment the participants embark on the structure, cliff or Via Ferrata, equipped with harnesses).
- Cancellation at the initiative of customers/participants: in the event of cancellation or modification less than 3 days before the outing, Obsession Minérale reserves the right to request a cancellation compensation of 20 € per person and per outing, or to modify the conditions of the service.

The participants undertake to pay the service in full at the end of it. The Client is responsible for the payment of all the participants in his group (between whom there is joint payment) and undertakes to cover the possible failure and non-payment of one or more of the participants.
Legal proceedings could be initiated in the event of non-payment of the sums due (service or cancellation compensation).
Payment is made on site by cheque, cash or holiday vouchers.
VIII. MISCELLANEOUS

Any request for information, additional information, request concerning the services of Obsession Minérale, must be addressed exclusively to Obsession Minérale, 100 Route de l'Arps, 26190 Saint Laurent en Royans.

Obsession Minérale is not responsible for the objects carried by the participants, whether on the cliff or in the canyon for the duration of the service (mobile phone, watch, gopro, cameras etc...). Containers whose absolute tightness cannot be guaranteed are only reserved for picnic provisions.
"Image rights": all the images of the participants (photographs or videos) taken during the performance by the instructor, may be used by Obsession Minérale, with the tacit agreement of the persons filmed or photographed, provided that they are neither degrading nor demeaning. A participant can always object to this rule by simple written request.
In the event of a dispute between the Customer and the company, the latter will endeavor to resolve it amicably (the Customer will send a written complaint to the professional or, where applicable, to the Customer Relations Department of the professional).
In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the Consumer Customer within the meaning of Article L.133-4 of the Consumer Code has the possibility of enter free of charge, if a disagreement remains, the competent mediator registered on the list of mediators drawn up by the Commission for the evaluation and control of consumer mediation pursuant to Article L.615-1 of the Consumer Code, to know :
